DISH Network TiVo, Fox, MSG Loss Hurts Dish Customers

The outlook for DISH Network and its subscribers is looking increasingly dim. Many industry insiders are predicting a downfall for the industry's No. 2 direct broadcast satellite business, citing its recent contract squabbles with a number of different content providers, including Fox Sports and Madison Square Garden (MSG) programming. The stock for the company has plummeted in recent weeks, and many feel it is simply a matter of time before more subscribers jump ship to the superior programming on DIRECTV.

In addition to diminished programming, DISH Network has also lost out on TiVo, which has signed an agreement with DIRECTV to create a new DVR and receiver specifically designed for the satellite service. DISH, meanwhile, is locked in a pricing fight with the Dish Network TiVo service as well, having taken some of its patents to court. In fact, The United States Patent and Trademark Office, or PTO, has recently made a ruling reaffirming TiVo's "Time Warp" patent, making DISH Network TiVo liable for up to $4 of licensing fees for every customer who makes use of the "Time Warp" technology. This will only seek to further raise the stock price of DISH Network packages, which in turn will turn more customers toward its competitors. Still some analysts maintain that the loss of DISH Network TiVo will be mitigated by deals with Google Video and Logitech International, albeit their Google TV software will retail for close to $300.

A far more dire outlook is the loss of both DISH Network TiVo and the fall sports programming. The company continues to tread on rocky terrain as it attempts to negotiate deals with both Fox Sports and MSG while simultaneously challenging their right to block the channels during negotiations. The bitter battle will not likely end soon, as DISH Network executives have been adamant about not budging from their stance, as CEO Charles Ergen maintains 90% voting power over decisions made by his company. Analysts have shown surprise that the CEO has shown so little interest in the negotiations, however, as well as little concern over the loss of TiVo.
