TiVo HD DVR Fighting Dish, DIRECTV Makes TiVo Deal

The squabbles between DISH and TiVo continue to heat up. According to new reports, Dish Network is arguing that the ruling by the United States Patent and Trademark Office backing TiVo's Time Warp DVR and TiVo HD DVR patent contains language that is grounds for a retrial.

After being ordered by a Texas court to disable an estimated 8 million DVRs that had made use of the Time Warp technology, DISH made an appeal to the federal circuit, stating that the patent was invalid because part of the claims made were listed in previous patents. DISH Network believes that the decision to validate the Time Warp patent is a kind of 'prosecution disclaimer,' consequently narrowing the scope of previous claims. A source from DISH Network states that as a result, while TiVo had already proven DISH had infringed, they had not done so based on this new, narrowed scope.

However, TiVo contends that the Patent and Trademark office has upheld the judgment three different times. While the office has re-examined the case on the behest of DISH, they have made no efforts to send the case to retrial, and the appeals by DISH have so far only delayed a resolution. TiVo originally sued DISH Network, owned by EchoStar Communications, back in January of 2004. As a result, DISH and EchoStar have already been forced to award TiVo over $100 million in damages when the Supreme Court declined to review the appeal two years ago. If this latest hail mary attempt fails, DISH Network will be forced to pay an additional $200 million in damages for the time warp and TiVo HD DVR technology.

Meanwhile, satellite leader DIRECTV has already inked a long term deal with TiVo, which should be available to customers starting next year. This represents a renewal of their previous relationship, and the new TiVo HD DVR has customers excited at the prospect of recording their favorite programs with the ease and flexibility of TiVo's award winning software. DIRECTV also continues to broker deals with broadcasters that DISH Network continues to squabble with, while at the same time reducing the costs of their lower tier packages to further accommodate consumers in this stagnant economy.
